Terms of service

1. Acceptance of the Terms
By creating an account, accessing, or using the Nordic Scan mobile application (“App”) you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the App.
2. Who We Are
“Nordic Scan,” “we,” “us,” and “our” refer to Nordic Scan, 795640 3rd Line EHS, Mono, Ontario L9W 5Z4, Canada. Contact: info@nordicscan.co
3. Eligibility & Age Gate
You must be at least 16 years old if you are located in the European Economic Area or the United Kingdom, or at least 13 years old elsewhere. By using the App you represent that you meet the applicable age requirement and can enter into a contract.
4. Account Registration
You agree to provide accurate information and keep it current. You are responsible for all activity that occurs under your account.
5. Subscriptions, Auto-Renewal & Payment
5.1 Plans
- Free tier – limited daily scans.
- Pro subscription – unlimited scans and all premium features for the billing period you select (weekly, monthly, yearly).
5.2 Displayed Pricing
Fees, currency, and taxes are those shown in the Apple App Store or Google Play storefront for your country at purchase time. Prices may vary by region and may change as described below.
5.3 Auto-Renewal & Billing
Your subscription automatically renews at the then-current price for your region and billing frequency unless you cancel at least 24 hours before the current period ends. Renewal charges are billed to your chosen storefront payment method.
5.4 Price Changes
We may change subscription fees for new periods. Apple or Google will give advance notice (typically ≥ 30 days) and explain how to cancel. If you do not cancel, you authorise the storefront to charge the new fee.
5.5 Promotions
Introductory prices or promo codes may apply only to the initial term; thereafter the subscription renews at the standard regional price.
5.6 No Developer Refunds
All purchases are processed by Apple App Store or Google Play. Nordic Scan provides no refunds. Any refund is at the storefront’s discretion.
5.7 Taxes
Fees include applicable sales, use, value-added, or similar taxes unless the storefront states otherwise.
6. License to Use the App
We grant you a limited, revocable, non-exclusive, non-transferable license to download and use the App for personal, non-commercial purposes, subject to these Terms.
7. User-Generated Content
7.1 Licence
You grant Nordic Scan a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to host, analyse, modify, and publicly display any photos or other content you upload—and data derived from them—even after you delete your account, insofar as that material has been incorporated into the product database.
7.2 Acceptable-Use Policy
You may not upload content that is illegal, harassing, misleading, infringes intellectual-property rights, contains others’ personal data without consent, or attempts to reverse-engineer the App.
8. Health & Medical Disclaimer
Ingredient analyses and product ratings are generated in part by automated systems. They are for informational purposes only and are not medical advice. Always consult a qualified health professional before making dietary or cosmetic decisions.
9. No Warranty
The App is provided “as is” without warranties of any kind, express or implied, except where prohibited by law.
10. Limitation of Liability
To the fullest extent permitted, Nordic Scan’s total liability for any claim arising out of or relating to the App will not exceed the greater of (i) US $100 or (ii) the subscription fees you paid in the 12 months immediately preceding the claim. This cap does not apply to liability that cannot be excluded under applicable law (e.g., personal injury caused by negligence).
11. Indemnity
You will indemnify and hold harmless Nordic Scan against any claims arising out of your breach of these Terms or misuse of the App.
12. Dispute Resolution & Governing Law
12.1 Ontario Law & Toronto Courts (default)
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, with exclusive jurisdiction in the courts of Toronto, except where local consumer laws let you sue in your home jurisdiction.
12.2 Mandatory Individual Arbitration (U.S. & Canada)
If you reside in the United States or Canada, any dispute we cannot resolve amicably will be finally resolved by binding arbitration administered by JAMS under its Consumer Arbitration Minimum Standards. - Class-action waiver: disputes must be brought individually. - Opt-out: email arbitration-optout@nordicscan.co within 30 days of first agreeing to these Terms; include your account identifier. - Small-claims carve-out: either party may pursue qualifying claims in small-claims court.
13. Changes to the Terms
We may modify these Terms by posting an updated version at least 30 days before it takes effect. Continued use after the effective date constitutes acceptance.
14. Termination
We may suspend or terminate your account or block access to the App at any time, with or without notice, if: 1. You breach these Terms or the Acceptable-Use Policy; 2. Your use poses security, legal, or reputational risk to us or others; 3. We are required to do so by law or a competent authority; or 4. We discontinue the App or any part of it.
If you have a paid subscription at termination not based on your breach, we will provide a pro-rated refund for the unused portion of your current billing period. Termination does not limit any other rights or remedies we may have.
